Child Support
Child support cases in Pennsylvania are governed by the Pennsylvania support guidelines. The PA support guidelines set forth the support which a parent should pay on the basis of both parties' net monthly incomes as defined in Rule 1910.16-2 and the number of persons being supported. The support of a child is a priority obligation so that a party is expected to meet this obligation by adjusting his or her other expenditures.
The amount of child support to be awarded pursuant to the Pennsylvania support guidelines is determined by factoring together the income or earning capacity of both parties and applying the guidelines calculations to determine a presumptive basic support obligation. If a conference officer determines that there is an obligation to pay support, there is a rebuttable presumption that the amount of the support determined from the guidelines is the correct amount to be awarded. The PA support guidelines are a rebuttable presumption and must be applied taking into consideration the special needs and obligations of the parties.
Pennsylvania child support cases can become quite complex. There are many special issues which arise often and must be dealt with effectively during litigation. For instance, where a party voluntarily assumes a lower paying job, there generally will be no effect on the support obligation. A party will ordinarily not be relieved of a support obligation by voluntarily quitting work or by being fired for cause. These cases require fact evidence to be presented at the initial support conference or before a support master or judge.
